LANGROUND TERMS AND CONDITIONS

These Terms and Conditions ("T&Cs") govern the relationship between Langround Ltd. (“Langround”, "Company," "we," "us," or "our") and any individual or entity ("Client," "you," or "your") that uses our services to pursue claims for compensation due to flight disruptions under Regulation (EC) No 261/2004 or any other applicable national or international regulations. By using our services, you agree to these T&Cs in full.

1. DEFINITIONS

For the purpose of these T&Cs, the following definitions apply:

  • “Agreement” refers to the binding contract between Langround and the Client formed when the Client accepts these T&Cs, either electronically or in writing, assigning Langround the right to pursue claims on their behalf.
  • “Claim” refers to any demand for monetary compensation made by the Client against an airline for disruptions covered under applicable aviation regulations.
  • “Flight Compensation” refers to the sum paid by an airline in response to a Claim, including but not limited to compensation for delays, cancellations, missed connection, and denied boarding.
  • “Pricing & Commission Structure” refers to the website page outlining the fees and remuneration Langround is entitled to upon successfully recovering Flight Compensation.

2. AGREEMENT FORMATION

2.1 Acceptance of T&Cs: By submitting a Claim through Langround's website, or any other communication channel, you agree to these T&Cs and grant Langround the exclusive right to handle your Claim.

2.2 Authorization: You confirm that you are legally entitled to file the Claim and that no other party has been authorized to act on your behalf regarding the same Claim.

2.3 Assignment of Rights: Upon entering into this Agreement, you assign to Langround all rights, title, and interest in your Claim. Langround will be solely responsible for pursuing the Claim, including taking any necessary legal actions.

3. CLAIM PROCESS

3.1 Claim Submission: Claims must be submitted through the channels provided by Langround. The Client must provide all relevant information, including but not limited to flight details, booking references, and any correspondence with the airline.

3.2 Evaluation: Langround will assess the viability of your Claim based on the information provided. While we strive to maximize the chances of a successful outcome, we do not guarantee that the Claim will be successful.

3.3 Claim Pursuit: Langround will take all necessary steps to recover Flight Compensation, including negotiating with the airline and, if necessary, initiating legal proceedings.

3.4 Legal Proceedings: If legal action is required, Langround may engage legal representatives to act on your behalf. You agree to cooperate fully and provide any additional documentation or authorization required by the legal representatives.

3.5 Settlement Acceptance: Langround reserves the right to accept or reject any settlement offers from airlines that are reasonable and in your best interest.

4. FEES AND PAYMENT

4.1 Service Fee: Langround operates on a 'no win, no fee' basis. If we successfully recover Flight Compensation, a 25% fee (including VAT) will be deducted from the recovered amount, as detailed on our Pricing & Commission Structure page (https://langround.eu/pricing).

4.2 Additional Costs: If legal action is required, Langround will cover any additional costs, including court fees and legal expenses, at no extra charge to the client beyond the standard 25% service fee. Please note, any bank fees incurred during the transfer of compensation to the client's account are the responsibility of the recipient and will not be covered by Langround.

4.3 Payment Process: All Flight Compensation recovered will be paid directly to Langround. After deducting our service fee, the remaining amount will be transferred to the client’s bank account. Langround is not responsible for any bank fees incurred during this transfer, and such fees will not be covered by us.

4.4 Direct Payments: If you receive any direct payment or compensation from the airline after assigning the Claim to Langround, you are obligated to inform us immediately and transfer our service fee. Failure to do so may result in additional legal action or charges to recover the owed service fee.

4.5 Refunds: If any overpayment occurs, Langround will refund the excess amount to the Client.

5. DATA PROTECTION

5.1 Data Usage: We will handle your personal data in accordance with our Privacy Policy, which complies with applicable data protection laws.

5.2 Data Sharing: Langround may share your personal data with third parties, including legal representatives and airlines, to the extent necessary to pursue your Claim.

5.3 Client Rights: You have the right to access, correct, or delete your personal data by contacting us as specified in our Privacy Policy.

6. TERMINATION

6.1 Termination by Client: You may terminate this Agreement within 14 days of signing the claim form by providing written notice to Langround. If you do not terminate the Agreement within this 14-day period, you will be obligated to pay our commission if the claim is successfully settled, regardless of when the settlement occurs.

6.2 Termination by Langround: Langround may terminate this Agreement if we determine that the Claim is unlikely to succeed or if you breach any terms of this Agreement.

6.3 Effect of Termination: If you terminate the Agreement within 14 days of signing the claim form, any ongoing actions to recover Flight Compensation will cease, and any rights assigned to Langround under this Agreement will revert to you. Additionally, we will provide you with a termination confirmation document, and any compensation received in the meantime, will be returned to the airline. Furthermore, we will not accept any new claims from you for the same flight.

7. LIMITATION OF LIABILITY

7.1 No Guarantee: While Langround will use its best efforts to recover Flight Compensation, we do not guarantee any specific outcome.

7.2 Liability Cap: Langround’s liability under this Agreement is limited to the amount of Flight Compensation recovered on your behalf.

7.3 Indirect Damages: Langround is not liable for any indirect, incidental, or consequential damages arising from the performance of this Agreement.

8. GOVERNING LAW AND DISPUTE RESOLUTION

8.1 Governing Law: These T&Cs are governed by the laws of the jurisdiction where Langround is registered, without regard to its conflict of law principles.

8.2 Dispute Resolution: Any disputes arising from these T&Cs or the Agreement shall be resolved through amicable negotiations. If a resolution cannot be reached, disputes shall be submitted to the competent courts of the jurisdiction where Langround is registered.

9. MISCELLANEOUS

9.1 Entire Agreement: These T&Cs, along with the Agreement and any documents referenced herein, constitute the entire agreement between Langround and the Client.

9.2 Amendments: Langround reserves the right to amend these T&Cs at any time. Any changes will be communicated to you, and continued use of our services after such notification will constitute acceptance of the revised T&Cs.

9.3 Severability: If any provision of these T&Cs is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

9.4 Assignment: You may not assign your rights or obligations under this Agreement without the prior written consent of Langround. Langround may assign its rights and obligations to any third party without prior notice.
